Our Client (plaintiff) wants to sue his next-door neighbour bill for the loss of his dog. Facts: On or about October 10, 2024, bill entered Alex's backyard to play with his dog, Maggie, who was already outside in the backyard playing. Alex believes that Bill must have left the gate open when she left the backyard, since Maggie escaped the yard, and remains nowhere to be found On or about October 17, 2024, Alex put up missing posters for Maggie, to no avail Prior to this incident, Alex states that he and Bill have had a friendly relationship, and has allowed him to play with his dog in the backyard before (at least 10 times prior to this incident), but each time before, he has either asked to go into the backyard to see the dog, or received a head nod (some kind of indication that her presence is known and approved of) When Alex confronted Bill about this incident (no date specified for this confrontation - Alex said it was verbal and in-person, so no documentation about it), she said that was not a big deal, since she had been in the backyard to play with the dog before and therefore had implied consent to go again Alex says that Bill is insistent this is not her fault and that she always closed the gate before leaving During the confrontation, Alex indicated that he wanted some kind of compensation for the incident, saying something along the lines of "you know what that dog cost..." . what are the strengths and weaknesses of our case.
