1. You are a billing clerk for a nursing home. Your regular responsibilities require you to work in the office. You do not usually have too much contact with the residents. You are in the employee lunchroom when you hear two nurses talking to each other about a very difficult patient. The two nurses are talking about how much easier it is to deal with Mr. Jones since he has been restrained to the bed. You know that this patient resident is difficult to deal with, but he is not usually a danger to himself or others. When you talk to your manager about your concerns, you are basically told not to worry about it since you are not a medical professional.
You are in fact not a medical professional. Do you have the same obligations to report the abuse? What specific steps do you take? Should you come forward even if you have no proof? Do you go over your boss' head? Who do you report your suspicions to? Your response should be at least 200 words in length.
2. Lucy, a senior nurse, applies for an open position with her current employer. The position would be a significant raise with more responsibility and better hours. Lucy is told that she was not qualified for the position, and someone who is more qualified has been offered the position. Lucy is upset but understands that someone better qualified was hired. As she is finishing her shift one day, Lucy overhears the nurse manager telling the director that she could not give Lucy the promotion. Lucy had been there so long and was making too much money, and the nurse manager could not afford to pay Lucy additional money. She had to hire someone younger for the promotion because she did not have the budget to pay her a higher salary for less work. Lucy has just been there too long. The nurse manager was able to get someone in their 20s and pay them half compared to what Lucy was making.
What claims, if any, can the nurse bring against the hospital? What specific law can she raise to support her arguments? Would she be successful in her claim? Why, or why not? What is your opinion? Be sure to include reasons to support your answer. Your response should be at least 200 words in length.
