Company ABC wants topurchase a piece of land to erect new production plant.Officers approach the owner ofthe desired plot. That party was fraudulent. Officers don’tknow about the reputation andhave deal with them. Seller party ask them to pay half money inadvance, and in return they willgive a stamp paper on which they will give receiving of the saidamount and half of the money willbe due on the day of transfer. After some days, officers of companyABC come to know that saidis already sold to another party and they are going to transfer infew days. The otherpurchase party is on the right because they have given advancemoney to sellers before Company ABC. Sodue to back date effect, legally company ABC has no claim on plot or that secondpurchaser party. But they have the right to sue seller in thecourt. Now a complicated conflicthas arises.
Now there are so manyconstraints and considerations in the way to resolve thisconflict.
