1. Elmer Fudd was involved in various businesses in which he worked with the movie industry locating filming locations, props etc. He decided to open an office in White Plains, NY and contacted First Fifth Bank for financing for the building, furniture, etc. He was referred to Wile E. Coyote, a vice president of the bank who orally agreed the bank would provide financing. Alas, Wile failed to mention that he only had express authority to approve loans up to $10,000 and Elmer was requesting $200,000. After providing Elmer with $185,000 of financing, the bank refused to provide additional funding. Elmer subsequently defaulted on the loans and the bank sued him for full repayment. Elmer countersued the bank for breach of contract. Who wins this kerfluffle and why?
2. Robin was employed by Wayne Industries as an assistant security guard. Wayne provides a fully stocked lunch room with a fridge, microwave, snacks, etc but Robin decided on day to go visit his friend, J. Oker for lunch. Robin was driving his own Robin-mobile when he collided with Clark Kent, who was riding a motorized scooter. Robin was negligent in this crash and Clark incurred significant injuries (apparently the Robin-mobile was made out of kryponite. Who knew?!) Clark sued both Robin and Wayne Industries alleging Robin was an agent of Wayne Industries at the time of the accident. Will Clark prevail against Wayne Industries? Why or why not? Will he prevail against Robin? Why or why not?
3. Goldilocks and her adopted son, Wee Baby Bear (whom you should assume has all the rights and privileges of any human) were waiting at a crosswalk for the "Walk" sign when a large van owned by Wicked Witch Hauling and operated by Belinda Goodwitch, jumped the curb and killed Goldilocks and severely injured Wee Baby Bear. Before reporting for work on the afternoon of this event, Belinda had been seen imbibing a great quantity of alcoholic beverages at the nearby Cauldron Pub. Just after the accident, her blood alcohol level registered as .15 percent. Evidence presented at the trial showed that alcohol and drug use was quite rampant at Wicked Witch Hauling and the company did little to prevent it. Goldilock's estate sued Belinda and Wicked Witch Hauling on her behalf and on behalf of the minor Wee Baby Bear. Fully discuss who is liable, to whom and why.
