Simon Banda and Rosemary Mulewa were engaged to be married. Prior to the marriage, Simon Banda agreed to make a dress allowance of K1.4 million a year to be paid in two instalments of K700,000.00. Simon paid the allowance for the first three years of their marriage and then he stopped paying. After Rosemary separated from Simon, she sued to recover K2.8 million arrears of the agreed dress allowance. Do you think she is entitled to recover the money?
