-In August 2010, OSHA issued citations to SeaWorld for apparently placing profit above employee safety following the death of Ms. Brancheau who was brutally killed by Tilikum, a nearly 12,000 pounds (5,443 kg) killer whale (Orcinus-orca) on February 24, 2010.
-The citations included fines totaling $75,000 for safety violations including the maximum $70,000 penalty for the "Willful" act of knowingly placing its employees at risk, a charge that has major implications beyond the monetary value.
-Orders to keep all orca trainers out of the pools (i.e. during "water work") and for them to maintain a safe distance or physical barrier when the whales sidle up to the stage or haul themselves out of the water in the slide-out area (i.e. during "dry work")
-SeaWorld agreed to end its water work, but still allows trainers to come into extremely close physical contact with the killer whales (except Tilikum)
-How do you think about OSHA's fines and citations? Do you think they are enough?
-What would you do if you are an agent of OSHA that deals with this lawsuit?
-What would you do if you are one of the top managers of the Seaworld? Do you want to keep appealing what you got from OSHA?
