Before Johnny can be suspended by a teacher, Johnny should receive a hearing by a school administrator. This hearing is to make sure that the teacher is stripping the student of their rights and fundamental fairness, fair processes, and fair procedures are used.
Before ever getting to the point of suspension, I would make sure a paper trail was already started. This paper trail would include any previous write ups, any notes written to the administrative staff, and any contact, such as emails, with the parent. I would also have verbal communication to the administrative staff about the student and ask for any suggestions because I believe for a student to succeed, they need to be in the classroom. If they are not in the classroom then they are not learning and not growing. Being a math teacher missing one lesson can set a student up for long term struggles because the way math builds on itself. If the student misses an opening lesson on the topic then it is harder for the student to catch up and succeed in later lessons. After the paper trail has been established then I would call the parent and set up a person meeting. During this meeting someone on the administrative staff would be present and the meeting would start with just the adults so that way we can get a game plan before talking to the student. Part of setting up the game plan would be introducing the parent to the paper trail so that way they could see that this is not just a one time thing but is a reoccurring event. After the plan of action has been approved by the parent, administrative staff member and myself, then the student will be told the plan. Then if the plan is is broken and the student continues to misbehave then suspending the student would be the next step.
The administrator must make sure all mandated procedures are met. These procedures include making sure a school rule has been broken, records of the behaviors have been compiled, the student gets a hearing and parents are made aware of the hearing, during the hearing all sides are heard uninterrupted, and parents are made aware of all records of behavior and parents are informed by both a mailed written notification of the suspension and phone call.
