A juice bar advertises that all of its drinks are dairy free. The drinks are served to the customers in takeaway cups.
Due to a stock shortage one afternoon, the juice bar owner sends one of his staff to purchase more coconut drinks from a local supermarket. This new product is labelled as containing condensed milk to thicken the drink.
The staff member buys the drinks and gives them to the owner who then puts the drinks in the cold room.
The owner does not check the ingredients list or inform his staff that the coconut drink product is different to the usual brand.
A family visits the juice bar and the children order coconut drinks. The parents ask if the drinks contain dairy products. The staff member serving them confirms 'all our drinks are dairy free'.
One of the children sips from her coconut drink and immediately suffers symptoms typically consistent with her severe dairy allergy. The child collapses and is rushed to hospital where she spends a week in intensive care.
During the resulting investigation, it is discovered the coconut drink contains dairy protein from condensed milk used as a thickener. The owner was unable to tell the investigators where the coconut drink product came from.
