With the legalization of recreational marijuana in Canada, there are a variety of questions and concerns that employers and HR departments have regarding the safety of their workforce. A significant concern relates to impairment in the workplace leading to safety incidents, conduct issues, and higher incidences of cannabis addiction.
A clearly defined safety policy for cannabis use is necessary-for example, the employee cannot be impaired at work. It is recommended that the organization distinguish between medical cannabis and recreational cannabis. The use of medical cannabis is protected under privacy legislation and it needs to be treated like any other medicinal drug that an employee would be prescribed.
Medical accommodation requires taking time to conduct a risk assessment and providing a thorough accommodation process.
Health and safety is the foundation of the policies that need to be put in place. Any kind of impairment at work that compromises safety is unacceptable and HR and the health and safety officer need to coordinate on both the policy and communication with the employee.
