We are going to learn and understand the legality of the affirmative action plan placed by the personnel director at East High School to remedy the vast disproportion of Hispanic residents and teachers to allow for education and the workplace to be further inclusive like their surrounding community. The personnel director must now weigh the decisions made to figure out if their actions were legally correct or not. The flowchart (Aamodt, 2023) in our textbook allows us to determine whether an employment process is legal, and the chart starts off with whether the requirement directly refers to members of a federally protected class and Bolton (the white employee who was not hired for a teaching job) does not classify as a federally protected class. Continuing, the next question in the chart asks if a court case, state, or local law expanded definition of any of the protected classes which to our knowledge it has not. Next, is the affirmative action plan has an adverse impact on members of a protected class, and once again there is no indication that Bolton is a member of a protected class a white man so no adverse effects.
