Managing Bounce Fitness Underperforming Individuals/Team Follow Up

Consider the following scenario:

Question: Following the one-on-one underperformance feedback meeting with John and coaching session provided relating to his performance concerns and coaching you initiated you noted that John hasn't improved and in the last six weeks, he has not been achieving the required work standard. His customers are complaining that he is still not providing them with their targeted results lacking motivation and interest. This has resulted in inappropriate conflict escalation in resolving matters, leading to poor customer feedback and significant rework. As well John has always been late to work at least THREE times per week over the last six weeks.

He has also used all of his personal leave; if he takes any more leave it will have to be leave- without-pay. Moreover, John is having a financial and gambling problem which is why he can't focus on his work leading to negative feedback that his not helpful, he often doesn't listen or take into account clients' needs and expectations. Team members and client's biggest complaint is that John is very inflexible and has no empathy. Therefore, the only option for him is termination for continued poor performance.

In this part you need to assume their leadership role and reflect on the scenario provided by College and or use their current workplace responding to underperforming individuals/ team according to organisational policies and legal requirements by initiating the following:
? First warning letter to John in accordance with Fair Work Act
? Guidelines to be followed when terminating John employment in accordance with Fair Work Act
? Organisational policies and procedures to prevent John unfair dismissal
? Reasons for employee termination that are considered unlawful
? Records keeping/ documentations protocols that will be followed by the organisation in accordance to organisational policies and legal requirements
? Criteria designed to Reinforce Excellence in Performance Throughout Bounce Fitness
