Generally there are 3 types of working relationships a) employees (or what is known as the 'standard employment relationship', b) dependent contractors and c) independent contractors.
David Doorey describes the standard employment relationship (SER) as one 'in which workers forego autonomy and agree to be subordinate to the authority and discretion of their employer in terms of when and how the work is performed in exchange for financial consideration'. Using the term 'subordinate' reminds us of the master-servant relationship.
Describe in your own words:
-The differences between an employee, dependent contractor and independent contractor.
-The key factors that courts and government agencies weigh when deciding on what type of working relationship exists.
-Why workers might prefer to be classified as a contractor.
-Why an employer would prefer to classify employees as contractors.Submissions are to include references to at least two sources, not including our text or power points. These could include legal opinions, postings on the websites of law firms or other sources. They may include precedent cases and referring to precdent cases is strongly enouraged.
