7. Ka Bhoy, a rebel fighter engaged in a long-running rebellion against the Philippine government, raped a civilian whom his cadre held hostage sometime in 2011. The civilian victim escaped, but was unable to file a criminal case against Ka Bhoy because his cadre remained in hiding. In 2031, Ka Bhoy was captured following an encounter with the military, and his civilian victim, upon learning that he was detained, filed a criminal complaint for rape against him, as a war crime under Republic Act No. 9851, considering that at the time he raped her, it was in the context of an armed conflict. Ka Bhoy claimed that her case had prescribed because 20 years had passed since its commission. Decide the case with a ruling on a) whether or not the act was a war crime and b) whether or not it has prescribed. "
