Question

When Beth and Doug divorced, their son Austin was 5 years old. As part of their judgment of divorce, both parents agreed to "begin setting funds aside for Austin to attend college." After Austin was admitted to Western Michigan University and received his federal loan, he was still $10,000 short of what he would need for the school year. Beth sent an email to Doug saying she would pay $5,000 and asked that he do the same. Doug responded that he could not. When Beth pursued the issue, she learned that Doug had no money to for Austin to attend college. She then filed a Show-Cause and Motion for Contempt in Wayne County Circuit Court, alleging that Doug violated the plain language of the judgment, relying on his email as her evidence. {A Show-Cause is a pre-requisite to the Motion for Contempt. The Movant must first prove that there is a reason to hold the Contempt hearing. Only after she succeeds will the court hold a hearing on the issue which, in this case, would be whether Doug violated the terms of the judgment of divorce.}
