On September 1, Alberto received the following flyer in the mail:
"Is your house looking a little dingy? Call Preeti, the painting specialist. I will expertly paint your house at a reasonable price."
On September 2, Alberto called the number listed on the flyer. When no one answered, he left the following message on Preeti's voice mail: "I will pay you $5,000 if you paint the exterior of my house. I will purchase the paint in the color of my choosing. I just need you to agree to apply the paint to my house. I must have your reply by September 30." Alberto included his contact information.
On September 7, Alberto received the following email from Preeti: "I drove by your house yesterday and determined the amount of work needed to paint your house. I will not be able to paint your house for less than $6,000." On September 15, Alberto received another email from Preeti that stated: "I have changed my mind. I will paint your house for $5,000. Unless I hear from you to the contrary, I will begin work on October 1." Alberto chose not to reply to this email.
On October 1, Preeti arrived at Alberto's house and started prepping the house for painting. When Alberto returned home later that afternoon and saw what Preeti was doing, he immediately ordered her to leave his property.
