Problem

You have been witness to a colleague attempting to access information about a patient that is not part of his patient case load. Your colleague explains that this person was once his neighbor and that he is concerned about her care. You witness him attempting to access the patient's PHI (both clinical and financial) multiple times. You are not certain if he gained access. While on lunch break you hear him on his cell phone telling someone that the patient is in the hospital and that he is trying to find out information as to why she is there. He identifies the patient by name and gives out the room number. When he realizes you have overheard the conversation he tells you he was speaking to his wife. He assures you that the patient would not mind him telling his wife that she is in the hospital as they are friends. Is the actions of your colleague a breach of HIPAA privacy and security?
