The Personal Information Protection and Electronic Documents Act (PIPEDA) and The Employment Standards Act (ESA)
Instruction: According to PIPEDA & the ESA answer the following.
Question 1. Your parents are returning from vacation tomorrow and you are expected to pick them up from the airport but you can't find their itinerary. You call their travel agent to get the arrival time of their flight. Can he/she give it to you? Why or why not?
Question 2. My brother-in-law is starting a company specializing in Costa Rica. He has asked if I can give him the names of my clients who have expressed an interest in Costa Rica. Can I give him the list? Why or why not?
Question 3. An Airline requests personal information of passengers that I have booked on flights. Can I provide it? Why or why not?
Question 4. A cruise company call me (the travel agent) for the client's contact numbers so they can advise the client of any last minute changes. Can I provide them with this information? Why or why not?
Question 5. Someone calls the agency and asks for the name of the manager. Can I give their name? Why or why not?
Question 6. In order to save time and money, can I send out a notice to all of my clients informing them that from time to time I will provide their names to third parties that have information of interest to travellers and if they do not want this information than they should contact me. Can I do this? Why or why not?
Question 7. I have already collected personal information about my clients and have already been given permission by these clients to contact them. I have over 1000 clients in my database. Do I have to do this all over again? Why or why not?
Question 8. Our office currently stores our past client files ("dead files") in the basement of the owner's home rather than on office premises. Is this acceptable? Why or why not?
Question 9. Kelly's regular work week runs from Monday to Friday. A public holiday falls on a Monday, and Kelly's workplace closes down for that day. If Kelly works the entire shift on the Friday before the holiday and the Tuesday after the holiday is she entitled to be paid for the public holiday? Why or why not?
