Retro Games agrees to sell Jimmy's Restaurant 10 refurbished, old time pinball machines or table games (such as PacMan). Retro will need to recondition each machine as they are old and unique. Retro agrees it will deliver the machines to Jimmy's on Saturday, December 8 at which time Jimmy's will pay for $22,000 for the group. Retro Games, the seller, agreed the risk of loss would pass to the buyer upon delivery.

In late November, the machines are destroyed by a fire. Is Retro Games liable to Jimmy's for breach of contract? Why or why not?
