A novice skier who is a student in a ski school stepped away from the instructor and from the group to take a selfie on the beautiful mountain slope. Earlier that day, he attended a safety lecture, where he learned about the many dangers inherent in skiing and, before he put on his skis, he signed a waiver absolving the ski school of liability for any injury that might befall him that day. But while he was setting up his selfie, he was struck and badly injured by an expert skier who had been skiing backwards down the slope. Please answer the following questions: Would a lawsuit brought by the injured skier be a criminal or a civil lawsuit? If the injured skier sued the ski school for negligence, what would the ski school say in its defense? If the injured skier sued the expert skier instead, why might the fact that he had been skiing backwards be important? Why do you think that the parties to these lawsuits would be interested in settling the lawsuits instead of going to trial?
