In 1991 the owner contracted with contractor to design and install a water system for a housing development. The construction of the system, except for the water storage tank, was completed in 1/91. The water storage tank was installed in 7/91. It is now 5/2001 and the owner wants to sue the contractor claiming defects. The statute of repose in the state is 10 years from the date of substantial completion. Can the owner legally sue the contractor? Why or why not?
