What I did well and what I could have done differently in the following response I wrote? Here is the question I had to respond to: What is substantive due process? What purpose does substantive due process serve to an individual involved in the judicial system? Why does the judicial system provide for substantive due process? And here is my response: A person's life, liberty, or property is protected by procedural due process in the United States. It ensures that certain protections are provided to an individual when the government acts in a manner that denies them their fundamental rights: A notice must be provided to the individual informing him or her of the government's intention to act, as well as the reasons for doing so. An individual has the right to present reasons why the government should not proceed with the intended action. A neutral decision-maker must make the decision. The individual can present evidence, and call witnesses, has the right to cross-examine opposing witnesses, and have decisions based on evidence. The right to legal representation, and the tribunal must use record of the evidence and provide written findings of fact and reasons for its decision (Procedural Due Process, 2024). This fundamental fairness protects citizens from unjust deprivation of their interests, these procedures vary depending on circumstances. Procedural due process serves a critical role in the judicial system by ensuring that an individual's rights are protected during government proceedings. It is a constitutional requirement that mandates the government to follow certain procedures when it acts in a way that denies a citizen of life, liberty, or property interests. Criminal justice workers provide for procedural due process to protect individuals from being criminally punished without notice and an opportunity to be heard.
