The independent contractor has the responsibility to ensure their actions, and the actions of anyone they employ are not negligent in any way. In the case of Staples v. Ohio Health, the independent contractor that was hired to cover shifts as a nurse in the emergency room, did not follow doctors orders. The nurse gave medication to the patient intravenously instead of intramuscularly as directed by the doctor. This caused an adverse reaction in the patient and further medical problems. The court found that the hospital was not liable as the nurse was working through a staffing agency. The staffing agency was found liable for the mistake and ordered to pay the patient for their medical expenses and pain and suffering.
