Appointing a Supreme Court justice when an opening on the court occurs has become increasingly contentious over the past decade. The refusal of the Senate to even consider the nomination of Merrick Garland, coupled with the contentious appointments of Justice Brett Kavanaugh and Justice Amy Coney Barrett have increased the partisan nature of Supreme Court appointments.

As a result, some Democratic strategists have suggested that the newly elected Democratic majority in Congress should increase the number of justices on the court. Others have suggested a system of rotating judges, that would reduce the lifetime tenure of justices. Opponents argue that increasing the number of justices could delegitimize the court and turn the appointment and confirmation process into nothing more than political theater.

You have been hired as a consultant to advise the newly elected Democratic President on whether or not he should support Congress moving to expand the Supreme Court.
