Dale Benson is an agricultural implements representative for a national heavy equipment company. His job responsibilities include personally visiting clients located throughout a tri-state area on a quarterly basis. In 2014, due to reductions in force, the company announced its intention to increase the territories of each of its representatives. Upon hearing this news of the territory expansion, Dale approaches his manager and advises, due to a previously disclosed and documented disability, he cannot take on two additional states because of the strain associated with the extra traveling. Dale requests that he be allowed to continue serving his originally assigned states. His request is denied shortly before Dale is scheduled for a performance review. Dale’s manager conducts a performance review and is unsure whether and how to factor in Dale’s unwillingness to take on new territories. Do you think Dale’s employer is required to honor his request?
