Imagine you are a Union International representative attempting to resolve a grievance in your organization. The grievance was filed by an employee who is challenging a disciplinary action given by management. You are working with the local members and your legal counsel to decide if the grievance must go to arbitration or not.

Consider both sides of this issue: union and management. Make a recommendation for BOTH management and union to present to their respective organization on the cost and benefits of the final award that could be associated with the decision.

SITUATION: A grievance was filed by an employee (John Smith) who was issued a disciplinary notice for slander of a peer (Robert Jones) due to a professional disagreement. Mr. Smith states that he did not take part in the slanderous conversation and has been falsely identified as a participant in the conversation which resulted in a disciplinary written up. The disciplinary notice states that if slanderous conversations continue, he will be terminated immediately.
