PERFORMANCE ACTIVITY

Objective: To provide you with an opportunity to demonstrate the required performance elements for this unit.

A signed observation by either an approved third party or the assessor will need to be included in this activity as proof of completion.

This activity will enable you to demonstrate the following performance evidence:

• Identify and apply work health and safety (WHS) legislative requirements applicable to the workplace, occupation and industry, including keeping up to date with legislation and relevant publications
• Identify and act on non-compliances with WHS legislation
• Identify duty holders
• Communicate WHS information to others
• Refer issues of non-compliance to responsible persons or authorities and seek advice from appropriate sources

Answer the activity in as much detail as possible, considering your organisational requirements.

As a workplace activity, or simulated workplace activity, perform the following:

1. For your business industry, identify three specific work health and safety requirements, check that these are being maintained appropriately in the workplace by referring to current legislation and any other relevant guidance documentation. Document this to show evidence of your monitoring activity.

2. Identify and list the different duty holders within your organisation.

3. Identify an occurrence of non-compliance and take action to resolve this by gathering information and evidence pertaining to the breach. This may include talking with employees and reviewing workplace and incident records. This should be reported/logged and documented to workplace systems.

4. Following on from the breach, refer to other duty holders (and/or authorities) to notify them of the breach and to obtain advice and guidance on what you need to do.

5. As a result of the breach, produce a written communication for employees detailing what has happened and what has been done to resolve this (you should leave out personal details of any persons involved to ensure confidentiality of personal information). This may be a staff memo, notice or email communication.
