Melissa Moon was staying at the Lakeview Hotel, our client. She walked into the bathroom to apply makeup & fix her hair in preparation for a banquet, when she slipped & fell on the bathroom's marble floor, breaking her wrist. Melissa has now sued the Lakeview Hotel for negligence, alleging that marble is by its nature slippery, & that Lakeview was negligent in using it for the bathroom floor. She does not allege that there was any defect in the floor; she is simply claiming that marble is too slippery to be used at all. Will she succeed?
