Question: You will utilize the knowledge gained in Module 2, Processing Crime and Incident Scenes, in order to identify items of evidence you believe you will find and that probable cause exists to collect. You will be required to specifically identify.
The physical location to be searched and the items inside of that location you intend to seize.
Of the items seized, what you intend to do with them (Forensic Examination) and what evidence (digital items) you believe probably cause exists to search and seize.
You should reference the Department of Justice's Guide: Searching and Seizing Computers and and Obtaining Electronic Evidence in Criminal Investigations, Appendix F, which begins on page 241 (https://www.justice.gov/sites/default/files/criminal-ccips/legacy/2015/01/14/ssmanual2009.pdf) to assist you whenever you are drafting a warrant. There will be certain paragraphs that will augment the template I created, and others which are not required. Each time to write a warrant, you will need to decide what fits and what does not.
You will use a modified version of the scenario from Discussion Board 1 in order to draft your Search Warrant. The details are below:
You are serving as a Digital Forensics Investigator with the Middle Georgia Digital Forensics Investigative Service and have been asked to assist in an Internet Crimes Against Children Task Force Investigation. Other Investigations within your Agency have downloaded 13,866 images and videos, amounting to more than 20 GBs, of known Child Sexual Abuse Material through the qTorrent Peer2Peer software. During the download, the Investigators identified the IP address the files originated from.
You completed a WhoIS Search in order to determine the ISP. Once completed, you subpoenaed the ISP, who stated during the time of the download, the IP address was assigned to subscriber Phillip Sherman of 42 Wallabby Way, Forysth, GA 31029.
You and your partner conduct surveillance at 42 Wallabby Way, where you identified two vehicles parked in the driveway. One vehicle was registered to Phillip Sherman and the second was registered to Darla Sherman. A search for wireless networks from the street showed one wireless network, "SharkBait", which was secured. No other houses were within a quarter mile of 42 Wallabby Way. Records checks of both individuals identified that Phillip Sherman was a 47-year-old dentist with no criminal record and Darla Sherman was a 20-year-old with one DUI arrest on the Middle Georgia University Campus.
