Question: Spend a 1/2 day watching the "legal" movie "The Firm" (1993) starring Tom Cruise and Jeanne Tripplehorn and answer specific questions about causes of action that were discussed in the movie as well as the business ethics of the defendant in the primary case covered by the movie. Business Law in the Movies-The Firm
Please read all of the questions below carefully before viewing the movie; it will help make sure you do not have to watch the movie more than once to get all the questions answered. You are welcome to get the movie on your own, but the Moorpark College library has it on reserve. Here is their guidance on checking it out:
You can distribute this to your students. A few connectivity items:
• Students should NOT be directed to create an account or login to the Swank site.
• However, they may be asked to login to their VCCCD accounts to authenticate.
• Please direct students to view the link in Google Chrome.
• If students are viewing on their phone, they will need to download the Swank Media Player
(Androids and iPhones).
If they are having issues connecting, please let us know immediately and we'll work with their support to fix the issue.
Now, here is the project:
a. Dr. Goetz counted seven different incidents of "white-collar" business crimes committed during the movie, but that may not be an exhaustive list. You need only find one example of commercial bribery, one of extortion, and one of mail fraud. For each of those 3 crimes, you must do the following
i. Write out the elements or prima facie case for each crime using your materials provided in Week 3, and what the government would need to prove that the perpetrator was guilty. (3 points for complete descriptions, 1 for each crime)
ii. Taking everything an actor says as "testimony," tell us about the commission of the crime in the movie; what is the evidence the government would have if they chose to prosecute the crime, and whether you believe it would result in a conviction using the appropriate burden of proof for a criminal case.
b. Analyze the ultimate crime of the movie, mail fraud, using the business ethics model we discussed in Week 2. Tell us about:
i. Identify 3 groups of stakeholders that are affected by the commission of the crime and tell us why they would be impacted. (5 points for a complete answer)
ii. For the stakeholder groups you identified above, which of the 3 ethics "rules" would each group cite from their point of view as the main reason the Firm should not have committed the crime. Explain your reasoning (6 points for a complete explanation, 2 points for each group).
