Assignment - Employment at Will Discussion
Description - EMPLOYMENT-AT-WILL
"An employer can terminate an employee for any reason, no reason, a good reason, or a bad reason, just not an illegal reason."
Barry Bean counter is a tax attorney who is employed by Bad Company, a private-sector employer located in New Jersey. Barry has no individual employment contract, but is given an Employee Handbook that provides: "employees will receive a final warning prior to being terminated from employment." Six months into his employment, Barry's boss directs him to falsify some federal tax returns. Barry objects, stating that he could lose his law license for committing fraud. Barry's boss immediately fires him, stating, "we do not need any goody-goody losers working at this Company."
Questions - Identify and discuss all legal claims that Barry may bring. What legal precedent (such as important past court decisions) would apply?
Will Barry be able to bring a constitutional claim? Why or why not?
