Linda was a sales rep whose job involved a lot of driving. After she was diagnosed with cataracts and told that within two years, she would be legally blind, her employer advised her to apply for disability leave. Although her vision did deteriorate over the next few years, it was not as severe as the original prognosis, so she wrote to her employer, asking to return to perform light duties or take on part-time work. The employer indicated nothing was available. Several months later, Linda's disability benefits were terminated, as she was deemed capable of returning to work in some occupation. Although her employer was notified of the change and of Linda's wish to return to work, it took no action. Four years later, Linda filed a human rights complaint. The employer argued that it had relied on information from the disability benefits provider indicating that she was unable to perform the available jobs. Do you think Linda's complaint will be successful? Explain your answer.
