Application: Human Resources and Annual Operating Plans-Role in Ethical and Legal Decisions

Being a defendant in a high profile, high stakes lawsuit is a worst-case scenario for a Human Resources Director and company executives. In the Discussion this week, you examined a case in which the Human Resources Director disagreed with the organization's CEO regarding potential ethical and legal matters. In many cases, unethical and illegal behavior flows, at least in part, from a failure to properly adhere to the implementation of the Annual Human Resources Operating Plan's required policies or practices, or failure to have any plan whatsoever. Every year, thousands of lawsuits and criminal complaints are brought against companies for engaging in unethical and/or illegal behavior at the operating level.

For this Assignment, conduct research using a variety of sources, including media, to identify a company involved in a legal dispute. Next, specifically, you must search the Lexis/Nexis database in the Walden Library to find the state or federal court case in which that company lost that lawsuit or should never have had that lawsuit that is related to HR practices or policies involving unethical or illegal practices and retrieve the case summary.

To complete this Assignment, in a 2- to 3-page paper respond to the following:

- Introducing the use of HR Operating Plans to address organizational behavior or practices, e.g., organizational ethics, or hiring practices based on federal mandates, and to ensure that organizations are guided to do the right things and understand the need for regulatory compliance, etc.
- Briefly review the key points of the case found in the Lexis-Nexis database.
- Explain how greater involvement by the Human Resources Department or Division and diligent adherence to the Annual Human Resources Operating Plan (or having a plan in the first place) might have systematically prevented the lawsuit or reduced its impact
- Be specific in providing details from the case and mapping those to arguments for why a thoughtful Annual Human Resources Operating Plan would have made both a short-term and a long-term difference

Assignment #2: HR and Annual HR Operating Plans - Their Role in Ethical and Legal Decisions

Here are some helpful insights into this week's formal paper:

1. First, for this Assignment, look in everyday sources to find a company involved in a legal dispute, including media, newspapers, broadcasts, etc.

2. Next, you must use the Lexis/Nexis database in the Walden Library to find the state or federal court case in which that company lost that lawsuit (or should never have had that lawsuit to begin with).

3. The case must be related to HR practices or policies involving unethical or illegal practices

3. Retrieve the case summary so you can use it in your paper to describe the case.

To complete this Assignment, in a 2- to 3-page paper respond to the following - here are the sections of your paper that need section headings, aside from the conclusion:

I. Introduce the concept of the use of an HR Operating Plans (through strategies) to address organizational behavior or practices, e.g., organizational ethics, or hiring practices based on federal mandates, etc., drawing upon your assigned readings or text.

II. Provide a brief summary (Lexis-Nexis data base) of the key points of the case you choose.

III. Explain the role of HR and their AHROP in preventing such legal issues: how greater involvement by the Human Resource Department or Division and diligent adherence to the Annual Human Resources Operating Plan (or having a plan in the first place) might have prevented the lawsuit or reduced its impact

IV. Explain how an Annual Human Resources Operating Plan would have made both a short-term and a long-term difference

- NOTE: You do not need to use your selected company, because you need to find a company that lost a legal case - hopefully, your company is not one of them. However, examining this case will give you sufficient insight regarding things you should consider about the company you DID choose, as you write your Annual HR Operating Plan for them (AHROP). For example, if they aren't paying attention to complying to federally mandated legislation (e.., EEOC, etc.), perhaps your chosen company needs to have a strategy that establishes a program to achieve regulatory compliance system-wide. Every assignment you have will contribute to your writing your final Capstone project, even the discussions.

The report is on Gucci-case in China. The claim is on illegal practices in labor management. There are unfair practices and subsequent legal and image losses to the company. AHOP would have averted that if properly designed and kept in place.
