Question: Assume the STEM program being developed at Bayside also included a very innovative software platform which Bayside was designing.
Assume the Powers was working with other members of the faculty and in-house IT personnel on the STEM program before he was fired.
Additionally, the entire program was considered revolution among those at Bayside working on it and it was expected to give Bayside a huge competitive advantage against other schools in the metropolitan area.
Also assume that parents would be draw from the metropolitan area to enroll their kids, but those living outside the metropolitan area would be turned off by the long drive.
Bayside is concerned about employees leaving and taking information about the STEP program and "improperly" competing against Bayside.
How would you suggest Bayside deal with concerns regarding current employees leaving Bayside to work at competing schools to develop a competing STEP program?
How would you ensure the steps would be enforceable is the matter was ever litigated?
