Case: Ethical decision making is crucial throughout our Criminal Justice system. It starts with the 911 caller and witnesses, then shifts to the police on the scene, to the investigators, to the attorneys, and finally to the judge and jury. If one person in that process makes an unethical decision, it can have devastating results for someone involved in the case. This can lead to a guilty person being released and never charged, or an innocent person getting convicted of a crime he/she did not commit and serving decades in prison. Our system is set up to include safeguards, but if no one reports unethical conduct then it can sometimes go unnoticed, with real potential for harm. The best practice is to be ethical and honest all the time. Fair, legal, ethical, and consistent behavior will result in the right outcome. Explain your choices in this scenario by addressing the following questions: Why might some prosecutors withhold exculpatory evidence to the defense? Provide several examples of situations where this might happen. Do you find any of these ethically or morally appropriate? Why? What is the distinction you've personally found that differentiates a moral reason for withholding from an immoral reason?
Question 1: If you were the county attorney in your area, how would you make sure your prosecutors remained ethical? What policies and procedures would you put in place? Provide specific details.
Question 2: What policies and procedures do you think would work best to prevent, detect, and discipline corruption in a police department? Be detailed and thorough in your response.
