Assignment: The goal is to provide students with scenarios in which they may be faced when employed for an organization as an HIM advocate. These scenarios will allow the student to use their HIM critical thinking skills in responding to each case keeping in mind the various standards and regulations introduced throughout the course. Depending on the case, these standards could range from state, federal , or other law, AHIMA code of ethics, and other concepts you learned throughout the course.
Expectations
Students are to:
Analyze each case and explain how they would handle the situation.
In some of the cases there may be a violation. In these cases, I want you to additionally:
Identify the violation
Explain the consequences if the violation was not rectified
Provide an idea on how to prevent the violation from happening in the future.
Please no "yes" or "no" answers without an explanation or points will be deducted. I want to see a supportive explanation (citations) of how you reached your answers. You may use resources such as the ROI toolkit, Breach toolkit, or any other credible source.
Here is an example:
A BA has a subcontractor that assists the BA with filtering medical bills through their scrub software.
Question: Since this is a subcontractor, do they have to comply with HIPAA Privacy Rule?
Explain: Yes, per ARRA, subcontractors who access PHI must adhere to HIPAA with or without a business associate agreement. Subcontractors are considered workforce members and are also subject to civil and criminal penalties that violate any HIPAA laws. (pages 220-221) (HHS 2010, 40873).
Case One
A law enforcement officer presented to the HIM department with a court ordered search warrant, requesting health information on Sylvia Donald who is in the hospital with a gun shot wound and is a suspect in an armed robbery.
Question: How would you handle this officer's request?
Case Two
Healthy Hospital has a contract with Really-Clean, a local janitorial company for the hospital. The janitorial services include cleaning the HIM department.
Question: As an HIM Director how would you ensure HIPAA Privacy was being complied with?
Case Three
A former patient presents themselves in person to request access to his medical records and demands that he get access now or they would be in violation of HIPAA. The HIM staff member was so worried that if she didn't comply with the request the patient would file a complaint, so she dropped all her court order and subpoena requests to copy this patient's record.
Question: As an HIM manager you observed this and decided to talk to the HIM staff member after the former patient left. What should the HIM manager say to the HIM staff member?
