Despite being given notice of the cancellation, the plaintiff proceeded to complete the bridge, and brought suit against the defendant for breach of contract. At trial, a breach was found and the judge instructed a verdict for the full amount of the claim in Peter Construction's favor. Douglas County appealed the verdict
