Scenario: After analyzing the market research report, you have determined the required services are commercial and there is a reasonable expectation you will receive offers from at least two responsible small business concerns. You next synopsized the requirement in accordance with FAR 5.201(b)(1). In response to the synopsis, South Georgia Medical (SGM) submitted a letter to the Contracting Officer. SGM contends they have an existing Indefinite-Delivery/Indefinite-Quantity (IDIQ) contract with Robins Air Force Base for complete physical examinations for new recruits, and the Government should modify their existing contract to add the fitness for duty medical examinations in lieu of awarding a separate contract. Can the existing IDIQ contract with SGM be modified to add the fitness for duty testing? Select one of the following options, and provide supporting rationale for your choice. The supporting rationale must address everything specified in the option you chose.
Option a: The fitness for duty examinations are outside the scope of SGM's existing IDIQ contract and would violate the Competition in Contracting Act (CICA). However, with proper justification, a Justification & Approval (J&A) for other than full and open competition could be executed to allow for the modification. (Supporting rationale must address all of the following: (1) how risk(s) to cost, schedule and/or performance were mitigated by the chosen option; (2) how the chosen option best meets the customer's needs; and (3) why it is in the best interest of the Government to execute the J&A and modify the SGM contract rather than award a separate contract.)
Option b: The fitness for duty examinations are outside the scope of SGM's existing IDIQ contract, and there is no justification for other than full and open competition. We must proceed with the new contract. Option c: The fitness for duty examinations are within the scope of SGM's existing IDIQ contract. We may proceed with a contract modification without additional justification. (Supporting rationale must address all of the following: (1) how risk(s) to cost, schedule and/or performance were mitigated by the chosen option; (2) how the chosen option best meets the customer's needs; and (3) how the fitness for duty examinations were determined to be within the scope of SGM's existing contract.)
