Tim Brady owned a farm called Goatacre. Tim had a son named Aaron Roger Brady and a daughter named Marcia Brady. Aaron Brady had a daughter named Cindy Brady. Cindy had a boyfriend named Keith Partridge. Tim had been having arguments with his granddaughter Cindy about Cindy living with Keith and not wanting to get married. In fact, Cindy and Keith had a child together named Jan Partridge. In his will, Tim conveyed Goatacre as follows: "To Aaron Roger Brady for life and then if my granddaughter Cindy is married, then to Cindy." He then bequeathed in his will to his daughter Marcia Brady all other property that had not already been conveyed. A year after Tim prepared his will, Tim and Aaron Brady died in a plane crash. To honor Tim's memory, Cindy and Keith got married.

Cindy believed she was the owner of Goatacre, so she and Keith took out a mortgage loan in the amount of $200,000 with Bank of the North. Cindy and Keith showed Bank of the North their marriage certificate. Bank of the North then agreed that Cindy and Keith owned Goatacre so that the entire property of Goatacre served as collateral for its loan to Cindy and Keith. Cindy and Keith defaulted on the loan and Bank of the North foreclosed on Goatacre.

Marcia believed that she was the owner of Goatacre. Marcia married Jack Everett in a community property state. Without Marcia's knowledge, Jack took out a mortgage loan in the amount of $200,000 with Bank of the South. Bank of the South believed that Jack and Marcia owned the property so that the entire property of Goatacre served as collateral for its loan to Jack. Jack defaulted on the Bank of the South loan, and Bank of the South foreclosed on Goatacre.
