Gillen, filed a defamation suit against the union for its picketing and signs. Gillen sought $500,000 in damages, despite the fact that he could identify no business losses because of the picketing and signs. Gillen's suit was dismissed by the court as "groundless." The union then filed an unfair labor practice complaint against Gillen, Inc., alleging that filing the suit against the picketing and signs served to coerce the employees in the exercise of their rights under Section 7.
