Problem: There was a case in Alaska in which the defendant was being tried for murder, in an area where very few outsiders ever came and settled. He was a member of a tribe that had lived in the region a long time. Fortunately for the prosecution, a few years earlier the state had collected enough samples from the local population to have a usable database of genotype frequencies for forensic testing. The defense requested they be provided with the names of all the people who contributed samples for the database (while the names are not published along with the STR allele frequencies, the keepers of the database must record them, as a means of insuring they don't get multiple samples from any one person, and you can obtain them by court order). The defense argued that a lot of those people might be related to the defendant, and if so, using that database would unfairly slant the interpretation of the forensic evidence in a way that worked against the defendant. How should the judge have responded?
