"Ok Charles, what are you seeing in the accounting records?"
"Well Tip, we have a little problem. Seems that PBE has not paid their last two quarterly tax payment to the IRS or the states of Nebraska or Iowa. That includes their own estimated taxes and employee payroll taxes."
Question #5 do you need to call in a tax attorney or can Charles handle this?
"George, you seeing anything in HR?"
"Yes, I am concerned about one thing that I've never seen before and I think it might be illegal. It seems if an employee gets hit with a child support order that they convert that employee from an employee to an independent contractor, so they don't have to be bothered with deducting child support from pay checks."
Learned, "George, it's not illegal to make an employee an independent contractor, but from a practical point it is kind of senseless. The Court can still order the deductions from funds due to the independent contractor. The real question is are we looking at sanctions for not taking the money out."
Question: How should Gustav handle this? Whatever action you recommend, do you try to have your attorney anything retroactive due to Learned's concerns?
