Somehow, Joel fails to obtain the transfer of the insurance policy to his name from Norie. Subsequently, a fire of unknown origin destroys completely the condominium unit. Who may collect the insurance?

The shipment was insured with Puro Bola Insurance Corporation (Bola).  Upon receipt of the shipment, it was found out that damages were incurred due to rusting caused by the entry of seawater on account of the defective drainpipe of the ship where said cargo was stored.  ABC demanded compensation under the insurance contract.

May ABC recover from Bola under the circumstances?  Explain
