Plaintiff Peters brought an action against Defendant Donaldson, alleging that Peters suffered a number of injuries as a result of a fall on Donaldson's doorstep. He alleges that Donaldson negligently failed to clear some ice from the steps. Donaldson has denied negligence on his part and denied that Peters suffered any injuries. In addition, he has alleged that Peters was contributorily negligent.

Peters has testified that he went to the emergency room at Ralston Memorial Hospital immediately after his fall.

He offers the testimony of Robert Recorda, the chief of the medical records department of Raulston Memorial. Recorda will testify, if permitted, that it is the policy of the hospital to require that admitting personnel in the emergency room record all information given them by persons seeking treatment, "if it might be relevant to treatment, and that policy is rigidly enforced." He would further testify that he had in his possession records made by Anna Armstrong (who was processing Emergency Room Records on the day in question) prior to Mr. Peters' treatment.

The form headed "Admission Record" says that:

"Patient Peters reports extreme pain in each leg when he tries to stand or walk, along with swelling and discoloration in each leg. I asked him how it happened, and he said that he slipped and fell on some steps."
