You are a legal advisor for the Department of Defense. You have been asked to create a 2-4 page memo highlighting the primary constitutional arguments that will be used in the case.

Question 1: Based of W&H and this week's lecture and materials, what constitutional issues are being disputed here? If the U.S. Supreme Court eventually considers this issue, what are the strongest and best arguments on both sides of the issue? Based on the application of the constitution discussed in the chapter, what level of scrutiny should the court apply in deciding the case and how is this likely to influence the court's ultimate decision?
