Activity - Decision Scale
The decision to plea bargain is often closely aligned with the same criteria used in the decision to prosecute, e.g., quality of evidence, witnesses, potential legal defenses, etc. Develop a point value scale that will facilitate prosecutorial decision making relative to the amenability of plea bargaining. The point scale should address the following parts.
Part A - Variables - Consider all the probable variables that would go into a decision and assign point values to each identified factor. For example, award a point for the presence of an eyewitness (or not), etc. Identify additional variables to total ten (10), each variable being worth one (1) point on the decision scale.
Part B - Instructions - When you complete the scale, provide basic instructions for its use. For example, consider a point total of 8-10 as indicative of a "no go" decision (no plea bargaining) and a score of five or less as pointing toward favoring plea bargaining.
Part C - Sample Scenario - Include a brief sample scenario to demonstrate how facts in a case would be applied to the scale and how a case assessment would be rendered. In the scenario address each of the variables and then draw a conclusion based on the scale.
