Thus, unauthorized agency fee deductions violate the First Amendment and are unconstitutional. American workers still have all rights under the NLRA to organize unions and engage in protected, concerted activities. However, the impact of both Right to Work laws and Supreme Court's Janus decision (for public sector unions) have the potential to severely decrease the amount of dues being paid to unions from workers.
