Deliverable: At minimum, it should be a three-page APA formatted paper not including the cover and reference page (60 points) to address the Week 4 questions. Add your Week 4 paper to your Week 2 submission. The full submission should be at minimum six pages, not including the cover sheet and reference pages. You will be graded on your answers to the Week 4 questions.
In our fourth week of evaluation and analysis of the Gabe Locker homicide, you will assume one of the following roles.
- Lead Homicide Detective Lemon
- Defense Attorney Larry Justice representing Slick Smith
You will respond to this week's Questions and Issues based on either role you choose.
ADDITIONAL CASE FACTS:
At the police precinct, both Slick and Henry are processed through the ID Bureau. Photos and fingerprints are taken of both of them. In addition, a buccal swab is completed for each of them, which collects their DNA.
Slick is wearing a red ball cap turned backward, a black tee shirt, jeans, and tennis shoes. Henry is wearing a red shirt, tan cargo pants, and tennis shoes. Slick has many tattoos down both arms, and Henry has no visible tattoos on his arms and face. After processing, they are both placed in separate interview rooms.
Later that morning, around 11 a.m., police detectives go to Slick's house. When they arrive, a handyman named Billy Stiver is at the home. Detectives speak to Stiver. During the conversation, Stiver opens the back door with a key to the house and walks into the kitchen. As they talk, Detectives follow Stiver into the house and into the kitchen. On the kitchen counter, detectives see a box of 9mm semi-automatic ammunition. Detectives open the box, and they notice some live rounds of ammunition missing. They take the box with them and enter it into evidence under the case for later processing.
When Detective Lemon and his partner interviewed Sarah Perkins, she initially told them that Gabe and a man with a ball cap on backward got into an argument in the bar over the pool table. She said the man had a friend with him who was wearing tan pants and a tee shirt. She told Detective Lemon this at the scene. During this initial interview, detectives were informed that both Slick and Henry had been stopped in the white Grand Cherokee and arrested on weapon charges. Detectives knew that the vehicle matched the vehicle that left the scene after the shooting. Sarah is also interviewed 2 days later at police headquarters.
Detectives also initially speak to Frank Myers and Samantha Peters, who were sitting in their car when the shooting occurred. Samantha said she heard a bunch of yelling back by the outdoor patio. She said that it's pretty dark back there. Frank said he saw two guys shoving each other. When they seemed to separate, one turned and started running, and that's when they heard the gunshots. He told detectives that he thought he heard two different guns being fired. But he wasn't sure. When asked how close they were, both said at least 45 ft away.
When Kelly Castle, Mary Fly, and Joe Gibson are interviewed a few days later, they all say they saw Gabe Locker get into a fight with a guy at the bar. All said they could recognize them.
Ballistics expert Josh Hall receives all the gun-related evidence. He gets the firearms, the spent shell casings found at the scene (three in total), the spent bullet recovered from Locker's body and the spent bullet that fell out of the morgue's body bag. He is also in possession of the box of ammunition from Slick's house.
If you chose the role of CSSU Detective Jacobs, answer the following.
- The night of the homicide, could Slick and potentially Henry be identified as suspects in the homicide? What procedure could be used? Are there any issues with your named procedure with an on-site identification?
- After the homicide, could the detective use any techniques to establish the identification of Slick? What procedure could they use? Are there any potential drawbacks to your named procedures?
- Based on the ballistics evidence, should Det. Jacobs make any requests of Ballistics Expert Josh Hall?
If you chose the role of Defense Attorney Larry Justice, answer the following.
Are there any issues with how detectives obtain the box of ammunition from Slick's house?
- Are the events that occurred at Slick's house a violation of any of his Constitutional rights? If so, provide specific detail.
- Can consent to search ever be given of property other than the property owner?
