Phyllis Wellmaker is a pediatrician living and working in Bibb County, Georgia, with an office near the campus of Mercer University. She uses a billing company called PayDay Ventures, LP. PayDay is based in Memphis, Tennessee, but they have offices in Macon. The company prepares and submits invoices for reimbursement for the patients Dr. Wellmaker has treated. PayDay Ventures uses a software program manufactured and updated by another company Polygon, which is located in Jackson, Tennessee. Dr. Wellmaker has recently learned that her medical practice lost nearly ninety-five thousand dollars ($95,000) in revenue because of errant billing practices. Dr. Wellmaker wants to bring a legal action against both PayDay and Polygon. She wants to file her lawsuit in either a court in Georgia or a federal court.
