I believe that the investigator would be held responsible but not their employer. According to Beatty, Bredeson, and Samuelson (2013) the fire investigator was negligent through a breach of duty. He failed to behave in a way that a normal fire investigator would by being careful to not to act in a manner that could cause a dangerous situation. He is also liable because of factual cause, it’s a fact that he knocked over the gas, the gas started the fire, and the fire injured people (Beatty et al 2013). I do not think thought that the employer would be held responsible because the type of harm was not reasonably foreseeable (Beatty et al 2013). The employer had no way of knowing that there was a gas container at the fire and wouldn’t be able to foresee that their employee would knock it over, and that it would cause another fire that injures someone.
