Problem: Alberta oil and gas companies are using pre-employment substance abuse testing even though it is prohibited. Their argument is that because they have multi-billion-dollar projects underway with a lot of potential for accidents, environmental damage, and so on, they want to be sure that they are not hiring employees who have substance abuse problems. They know that their young, transient, and relatively wealthy oil sands workforce commonly abuses drugs and alcohol. How could this situation be resolved in the spirit of the law on accommodating disabilities?
